Horizen Ag, Inc. (“Horizen Ag,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, and disclose personal information in connection with our websites, marketing activities, and communications, and the rights and choices available to you.
This Privacy Policy applies to personal information we collect as a controller of that information — for example, when you visit our websites, request a demo, correspond with our sales or support teams, attend an event, or receive our marketing communications.
This Privacy Policy does not apply to any personal information that we process on behalf of our customers through their use of the Services (“Customer Data”). Our customers determine the purposes and means of processing Customer Data. Our handling of Customer Data is governed by the agreement between Horizen Ag and the relevant customer, including our Terms of Service and the Data Processing Addendum, and not by this Privacy Policy. If you believe your information is held by Horizen Ag as Customer Data and you wish to exercise rights over it, please contact the Horizen Ag customer that provided it; if you contact us instead, we will refer your request to that customer.
We may revise this Privacy Policy from time to time. If we make material changes, we will notify you by updating the date above and, where required by law or otherwise appropriate, by additional notice. Your continued use of our websites after the effective date constitutes acceptance of the revised policy.
Information you provide to us. This may include your name, business email address, telephone number, employer, job title, mailing address, the content of messages you send us, information you provide in surveys or in connection with events, and billing and payment information where applicable.
Information collected automatically. When you interact with our websites or emails, we and our service providers may use cookies, pixel tags, web beacons, software development kits, and similar technologies (“Technologies”) to collect device identifiers, IP address, browser type and language, operating system, referring and exit pages, pages viewed, links clicked, dates and times of access, and similar usage information.
Information from third parties. We may receive information about you from business partners, marketing and lead-generation providers, event co-hosts, publicly available sources, and social media platforms where you interact with our content.
We do not knowingly collect sensitive personal information through our websites, and we ask that you not submit it to us. We do not use or disclose sensitive personal information for purposes of inferring characteristics about you.
We use personal information to: operate, maintain, and improve our websites; respond to your inquiries and provide customer support; process transactions and send related information; send marketing and promotional communications consistent with your choices; conduct research, surveys, and analytics; personalize your experience; enforce our terms and policies; detect, investigate, and prevent fraud, security incidents, and other unlawful or prohibited activity; and comply with legal obligations.
We use artificial intelligence and machine learning technologies in operating our business. In connection with the personal information described in this Privacy Policy, this may include automating and improving responses to inquiries, prioritizing outreach, analyzing website engagement, and improving our products and marketing.
Separately, and as described in our Terms of Service, we create aggregated, de-identified, and anonymized data derived from Customer Data (“Derived Data”) and use it to develop, train, validate, benchmark, and improve our services and our machine learning and artificial intelligence models. Derived Data does not identify, and is not reasonably capable of identifying, any individual or customer. We do not attempt to re-identify individuals from Derived Data and we contractually prohibit recipients from doing so. Our rights and obligations with respect to Derived Data are set out in our Terms of Service and Data Processing Addendum.
We do not use Customer Data to train models that are made available to other customers except in de-identified and aggregated form as Derived Data.
Certain features of the Services allow users to connect their Google accounts and Google Workspace data (for example, Gmail) to Horizen through Google’s APIs, using Google’s OAuth consent process, which describes the specific permissions requested. Horizen’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. The use of raw or derived user data received from Workspace APIs will adhere to the Google User Data Policy, including the Limited Use requirements.
We use Google user data only to provide and improve user-facing features of the Services that are prominent in the requesting user’s interface — for example, syncing email associated with customer, vendor, and transaction records and enabling AI features to act on that email at the user’s direction. We do not transfer Google user data to third parties except as necessary to provide or improve these user-facing features, for security purposes, to comply with applicable law, or as part of a merger, acquisition, or sale of assets after providing notice. We do not use Google user data for advertising. We do not permit humans to read Google user data unless we have the user’s affirmative agreement, it is necessary for security purposes or to comply with applicable law, or the data has been aggregated and anonymized for internal operations.
Google user data, including Gmail content, is never used to create, train, or improve any machine learning or artificial intelligence models, whether our own or those of third-party providers. For the avoidance of doubt, Google user data is excluded from the Derived Data described in Section 3.1.
Service providers and processors. We disclose personal information to vendors that perform services on our behalf, including hosting and infrastructure, IT support and security, payment processing, customer relationship management, analytics, email delivery, and professional advisers. These vendors are permitted to use the information only to perform services for us.
Analytics providers. We use analytics services, including Google Analytics, that use Technologies to help us understand how our websites are used.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors for support services, such as customer service or delivery, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Business transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, personal information may be transferred as part of that transaction, subject to applicable law. We will provide notice where required.
Legal and safety. We may access, preserve, and disclose personal information if we believe in good faith that doing so is required or appropriate to comply with law or legal process, to respond to lawful requests from public authorities, to enforce our agreements, or to protect the rights, property, or safety of Horizen Ag, our customers, or others.
With your direction. We disclose personal information at your direction or with your consent.
Marketing communications. You may opt out of marketing emails using the unsubscribe link in any such message or by contacting us. You may opt out of text messages by replying STOP. You may continue to receive transactional and relationship messages.
Technologies. Most browsers allow you to refuse or delete cookies. Refusing cookies may affect the availability and functionality of our websites.
Depending on your state of residence and subject to applicable exceptions, you may have the right to: confirm whether we process your personal information and access it; obtain a copy in a portable format; correct inaccuracies; request deletion; opt out of targeted advertising, of the sale or sharing of personal information, and of certain profiling; limit the use of sensitive personal information; and not receive discriminatory treatment for exercising these rights.
Twenty states currently have comprehensive consumer privacy laws in effect. We extend the rights described above to residents of every state whose law provides them, and we do not condition their exercise on your state of residence.
To exercise a right, submit a request to privacy@horizen.ag or through the mechanism identified on our website. We will verify your request, generally by confirming control of the email address associated with the information or by requesting additional information sufficient to establish your identity. We will respond within the period required by applicable law, and in any event within forty-five (45) days, subject to any permitted extension of which we will notify you. You may designate an authorized agent to submit a request on your behalf, subject to verification.
Appeals. If we decline to act on your request, you may appeal that decision by replying to our response or writing to privacy@horizen.ag with the subject line “Privacy Appeal.” We will respond to appeals within the period required by applicable law. If your appeal is denied, you may contact your state attorney general.
We recognize and honor universal opt-out preference signals, including the Global Privacy Control, transmitted by your browser or device, where required by applicable law. A signal received from your browser will be applied to the device and browser from which it was sent, and to your account where you are logged in.
California residents have the rights described in Section 5.2 under the California Consumer Privacy Act, as amended. In the preceding twelve months, we have collected the categories of personal information described in Section 2, for the purposes described in Section 3, from the sources described in Section 2, and have disclosed them to the categories of recipients described in Section 4.
We do not sell personal information for monetary consideration. To the extent any disclosure described in Section 4 constitutes a “sale” or “share” under California law, you may opt out as described in Sections 5.2 and 5.3.
We retain personal information as described in Section 7. We do not use or disclose sensitive personal information for purposes other than those permitted without a right to limit.
Nevada law permits Nevada consumers to opt out of the sale of certain covered information. We do not currently sell covered information as defined under Nevada law. If you wish to submit a request in the event our practices change, contact privacy@horizen.ag.
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, appropriate to the nature of the information and the risks involved. We review these safeguards periodically. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; where an incident occurs, we will notify affected individuals and authorities as required by applicable law.
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, and thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Criteria used to determine retention periods include the nature and sensitivity of the information, the purposes for which it is processed, whether the purpose can be achieved by other means, and applicable legal requirements.
Our websites are operated in the United States and intended for users located in the United States. If you access them from outside the United States, you do so on your own initiative and are responsible for compliance with local law. Information collected will be processed in the United States.
We do not use automated processing to make decisions about you that produce legal effects concerning you or similarly significantly affect you. Where we use automated tools to prioritize outreach or personalize content, a human reviews any resulting decision that would materially affect you. Where applicable law grants you the right to opt out of profiling in furtherance of such decisions, you may exercise it as described in Section 5.2.
Our websites and Services are directed to businesses and are not intended for children. We do not knowingly collect personal information from children under 16. If you believe a child under 16 has provided us personal information, contact privacy@horizen.ag and we will delete it.
Our websites may contain links to third-party sites and services that we do not control. This Privacy Policy does not apply to them, and we are not responsible for their practices. We encourage you to review their privacy policies.
If any provision of this Privacy Policy is held invalid or unenforceable, the remaining provisions remain in effect.
